Overview
In response to ongoing COVID-19 concerns, the Department of State (DOS) has issued a temporary final rule that permits consular officers to waive the in-person appearance requirement for individuals applying for an immigrant visa stamp in the same category and on the same basis as their initial application.
What are the Changes?
The previous in-person requirements for an oath, interview, and execution of applications will be waived for certain replacement immigrant visa applicants, provided:
- Their immigrant visa was issued on or after August 4, 2019
- They did not travel to the US with an immigrant visa
- They are seeking an immigrant visa in the same classification (i.e., replacement immigrant visas)
Looking Ahead
The rule will remain in effect through December 13, 2023. Even for applicants who meet all the DOS criteria, waivers will still be granted individually at the discretion of a consular officer. Applicants may still be required to submit updated documents, pay application fees, and have a medical exam.
