Overview

The US Citizenship and Immigration Services (USCIS) has announced an update to Form I-765, Application for Employment Authorization. Starting May 29, 2025, USCIS will only accept the January 20, 2025, edition of the form. Applicants filing on or after this date must ensure they use the correct version, or their application may be rejected.

Until May 28, 2025, USCIS will continue to accept the August 28, 2024, edition of Form I-765. This transitional window provides applicants and their legal representatives with time to adjust to the updated version. Form I-765 is a critical application for noncitizens seeking work authorization in the US, and staying current on form editions is essential for maintaining compliance and avoiding unnecessary processing delays.

Applicants can verify the edition date by checking the lower-left corner of the form. USCIS recommends downloading the latest version directly from its official website to ensure accuracy and ensure it is accepted.

Looking Ahead

Employers and foreign nationals should ensure that all Form I-765 submissions made on or after May 29, 2025, use the updated January 20, 2025, edition. Immigration counsel and HR teams should prepare for the change by updating internal processes and notifying affected individuals. Timely compliance will help avoid processing setbacks and maintain uninterrupted employment authorization.
