Overview
US Citizenship and Immigration Services (USCIS) has announced that it received enough petitions to reach the fiscal year (FY) 2023 H-1B cap. That includes 65,000 H-1B visas in the regular cap and 20,000 H-1B visas for the master’s cap.
USCIS has also finished sending non-selection notices to registrants’ electronic accounts. Petitioners who correctly submitted their registrations for the FY 2023 H-1B cap season but whose petitions were not selected will receive a notice from USCIS saying that their petitions were not selected and are therefore not eligible to file an H-1B cap petition.
Although it has reached the H-1B cap, USCIS will still accept and process other H-1B petitions that are exempt from the cap, including petitions filed to:
- Change employment terms for current H-1B workers
- Allow current H-1B workers to change employers
- Allow current H-1B workers to work simultaneously on other H-1B petitions
- Extend the amount of time a current H-1B worker can stay in the US
