Overview

The Department of Homeland Security (DHS) announced on June 27, 2025, the termination of Temporary Protected Status (TPS) for Haiti. This will take effect on September 2, 2025. The official decision was published in the July 1, 2025, edition of the Federal Register. Notably, although the termination announcement states that it will take 60 days from the date of publication, the effective date will be September 2, 2025, the first business day after the Labor Day holiday. This action withdrew the final six months of the Haiti TPS designation, shortening the validity end date. The vacatur has been challenged in multiple cases.

Employers now have 60 days to prepare for the reverification and possible termination of impacted employees. To prepare, it is advised that employers:

  • Reverify those whose Employment Authorization Documents have been auto extended to the new expiration date of September 2, 2025; and,
  • Work with their operations partners to determine any workforce continuity gaps that could result from these individuals losing work authorization.
