The Department of Labor (DOL) has updated its processing times for prevailing wage determination (PWD) and permanent labor certification (PERM) requests.
What are the Changes for PERM?
On November 30, 2020, the DOL was adjudicating applications filed in June 2020 and before. It was conducting audit reviews for PERM applications filed on or before January 2020, and it was reviewing appeals for reconsideration filed in August 2020 and earlier. The average PERM processing times were 164 days for adjudication and 308 days for audit review.
What are the Changes for PWD?
On November 30, 2020, the National Prevailing Wage Center was processing PWD requests that were filed in July 2020 or before for PERM and H-1B cases. The Center was also considering redeterminations filed in October 2020 or before for PERM cases. No redeterminations were reported pending for H-1B. Reviews were underway for PERM cases filed through September 2020. No reviews were reported for H-1B. The average processing time for PWD was 121 days for H-1B (OES). For PERM, average processing times were 119 days (OES) and 108 days (non-OES).
