Overview

On November 1, 2024, individuals in the Deferred Action for Childhood Arrivals (DACA) program may be eligible for federal healthcare coverage.

On May 3, 2024, the US Department of Health and Human Services announced a final rule giving DACA recipients expanded access to healthcare through the Affordable Care Act Health Insurance Marketplace (ACA Marketplace) and the Basic Health Program (BHP).

The final rule is effective on November 1, 2024. For 60 days following the rule’s implementation, DACA recipients may qualify for an enrollment period to choose a health plan through the two available programs. Individuals who apply for coverage during the open enrollment period may have health coverage starting December 1, 2024, through the ACA Marketplace or starting on November 1, 2024, through BHP.

The final rule will extend healthcare coverage to approximately 100,000 previously uninsured DACA recipients.
